This policy outlines Mitty Supply, LLC’s position regarding product compatibility and limits of liability when Mitty Supply branded products or Melasty products are used with parts, equipment, or systems that are not expressly identified as compatible.
Scope
This policy applies to all customers, purchasers, distributors, resellers, and end users of products sold or distributed by Mitty Supply, LLC, including but not limited to Mitty Supply branded products and Melasty products.
Compatibility Responsibility
Mitty Supply, LLC designs and sells products intended for use with specific components, systems, and configurations as described in official product documentation, listings, manuals, or written guidance provided by Mitty Supply, LLC or the manufacturer.
Customers are solely responsible for:
- Verifying product compatibility before purchase and use.
- Ensuring that any product is installed, connected, and operated only with compatible parts, equipment, and systems.
- Following all installation instructions, operating guidelines, and safety recommendations provided by Mitty Supply, LLC or the manufacturer.
No Liability for Incompatible Use
Mitty Supply, LLC is not liable for any damage, loss, injury, malfunction, reduced performance, or failure resulting from:
- Use of Mitty Supply or Melasty products with incompatible, modified, third‑party, or non‑approved parts or systems.
- Improper installation, misuse, alteration, or unauthorized modification of any product.
- Failure to follow product instructions, warnings, or compatibility guidance.
This limitation applies to, without limitation, damage to equipment, property loss, personal injury, loss of livestock, loss of production, downtime, or financial loss.
Warranty Exclusions
Any express or implied warranty offered by Mitty Supply, LLC or the manufacturer is void if a product is used with incompatible parts or systems, or if the product has been altered, misused, or installed contrary to provided instructions.
No Guarantee of Third‑Party Compatibility
Mitty Supply, LLC does not guarantee compatibility with third‑party components, systems, or accessories unless explicitly stated in writing. References to third‑party products are provided for convenience only and do not constitute an endorsement or guarantee of compatibility.
Customer Acknowledgment
By purchasing or using products sold by Mitty Supply, LLC, the customer acknowledges and agrees that:
- They have independently verified compatibility.
- They assume all risks associated with use on incompatible or non‑approved systems.
- Mitty Supply, LLC shall not be held responsible or liable for any resulting damage or losses.
